Terms & conditions

These terms govern your use of leihamartinart.com and any order placed through it. By using the site or placing an order you agree to these terms. Please also read our Order & commission policy, which forms part of these terms.

1. The studio

Leiha Martin Art is a sole-trader fine-art studio in the United Kingdom. References to “we”/“us”/“our” mean Leiha Martin Art.

2. Use of the website

You may browse the gallery and place orders for personal, non-commercial use. You may not copy, reproduce, distribute or commercially exploit any image, artwork or text on the site without our prior written permission.

3. Orders

All orders are subject to acceptance by the studio. We may decline an order at our discretion (for example, where a reference photograph is not of sufficient quality for us to produce a portrait of the standard we are willing to put our name to). If we decline an order, you will receive a full refund.

4. Pricing & payment

Prices are shown in GBP (£) and are payable in full at the time of order. Payment is processed by Stripe. Once payment is confirmed your order moves into our queue.

5. Intellectual property

The original artwork, the digital scan of the artwork, and any photographs of the artwork remain the intellectual property of Leiha Martin Art. You receive a physical copy (original or print) for your personal, non-commercial enjoyment. The right to reproduce the artwork is not transferred with the sale. By submitting a reference photograph, you confirm that you own or have permission to use it.

6. Delivery

Estimated delivery times are provided in good faith but are not guaranteed. Risk in the goods passes to you on delivery to the address you supply. Please check the address carefully before paying.

7. Refunds & returns

Because each portrait is bespoke and individually drawn from your reference photograph, original commissioned artwork is non-refundable and non-returnable. Please read our Order & commission policy in full before ordering.

Fine-art prints of your own photograph are also produced to order and so are non-refundable, except where the print arrives damaged or differs materially from what was ordered (see the order policy).

8. Liability

Nothing in these terms excludes liability that cannot be excluded under English law (such as for death or personal injury caused by our negligence, or for fraud). Subject to that, our total liability in respect of any order is limited to the amount paid for that order.

9. Governing law

These terms are governed by the laws of England and Wales, and any dispute will be subject to the exclusive jurisdiction of the English courts.

10. Changes

We may update these terms from time to time. The version in force when you place your order is the version that applies to that order.
